The argument

Twenty-one quarts. The Code of Federal Regulations specifies exactly one cooker, to a tenth of an inch, and it is not for cooking.

Start with the count, because it is the whole surprise. Across all fifty titles the exact phrase pressure cooker returns one section: 21 C.F.R. 175.300. Not a cookware rule, not an appliance rule. Resinous and polymeric coatings.1 The section's opening sentence is a conditional permission, and it names nine activities a coated article may be intended for, one of which is preparing food.2 Then, in its equipment paragraph, it specifies the vessel: twenty-one quarts, a pressure gage, a safety release, a removable rack, 12.5 inches inside diameter by 11 inches inside height, twenty pounds per square inch safe operating pressure. The spelling gage is the Code's own.3 Inside that one section the phrase is not rare at all. It appears 26 times, out of twenty-seven uses of the word cooker, and the twenty-seventh drops the adjective in the middle of an instruction. In the same section, nonstick returns zero, skillet zero, saucepan zero and rice zero.4 Title 21 uses the word in one other section, 113.40, in its industrial sense, and that section was located and not read.5

Then the vocabulary, which is where this gets strange. Multicooker returns zero across the Code, and so do air fryer, electric kettle, deep fryer, rice cooker and slow cooker. The one kitchen term that is present is hot plate, in nine distinct sections, one of which is 175.300 itself.6 Under the name people actually use, though, a slow cooker is in there: crock pot appears in exactly one section, 32 C.F.R. 79.6, in a sentence saying infant bottles are never heated in one.7 A toaster oven appears once, in Appendix B to 12 C.F.R. part 707, inside a model advertisement a credit union might run, and the Code writes (insert brand name) and declines to fill it in.8 The rest is words meaning something else: the only frying pan in the Code is a tract of land in North Carolina open to hunting, a skillet blind in the workplace standards is a plate for closing a pipe, and a skillet in the meat and poultry labeling rules is a pictogram. The one place a federal rule names a cooking appliance as a cooking appliance and attaches a requirement to it is 16 C.F.R. 1505.3, in the regulations for electrically operated toys, where it has sat since 1973.9

What does not follow from any of that is set out in the middle of this page rather than buried at the end. A word being absent from the Code is a fact about the Code; it is not a fact about anybody's duties, and three provisions found without searching for the word cooker make the easy conclusion false. 10 C.F.R. 430.2 excludes portable and countertop electric-resistance ovens by name, which is a drafting choice about a named thing rather than an absence. The same section defines a portable indoor conventional cooking top, and 10 C.F.R. 430.32(j)(1)(ii) has barred a constant burning pilot light on the gas version since April 9, 2012. And the reporting duty at 15 U.S.C. 2064(b) runs whether or not any standard exists for a product.10

What the instrument actually does is the second half. Mapped end to end the section is nine paragraphs, and the only quantity in it is a limit of 0.5 milligram per square inch of chloroform-soluble extractives for a one-time-use container of not more than a gallon.11 Its reach is wider than the statute's: 21 U.S.C. 348(h)(6) lists five activities, the regulation lists nine, the five sit entirely inside the nine, and one of the four the regulation adds is preparing.12 Paragraph (a) has two branches, and the second is written for a coating intended for repeated food-contact use, serving as a functional barrier between the food and the substrate on any suitable substrate; the single most specific duty in the section attaches only to that branch and it is about washing before first use.13 Coatings are then characterized three ways, all three by how the film was formed rather than by what it is made of, and the substances they may be formulated from are three cross-references rather than a list.14 The statute defines food contact substance twice in one subsection, once generally and once as one filer's own substance, expressly excluding an identical substance from anyone else.15

And the tests are graded almost entirely by heat. Table 2 sorts everything into eight lettered conditions, from high temperature heat-sterilized over 212 F down to frozen storage, and three of the eight headings state the axis in the negative as no thermal treatment in the container.16 Table 1 sorts food into eight numbered types by acidity, fat and emulsion direction, and disposes of the eighth in a parenthesis: dry solids, no end test required.17 Paragraph (e) then sets out seventeen protocols, each a liquid at a temperature for a time, each saying what it simulates, and the cooker appears in two different roles two paragraphs apart.18 Heptane stands in for fat, and the table carries an arithmetic instruction: heptane extractivity results must be divided by a factor of five in arriving at the extractivity for a food product. Eleven words of footnote remove wax-lined containers from that branch entirely.19 Everything this page declines to conclude is published in one list so the other nineteen cards can be held against it.20
